OSHA Recordkeeping for Landscaping Services

Landscaping headcount swings with the season, and both thresholds look at the peak: the size exemption at the company's highest headcount last year (29 CFR 1904.1(b)), the filing thresholds at each establishment's (1904.41). A company that runs 8 people in winter and 25 in summer keeps the log and, as an establishment of 25, files its 300A.

Who keeps and files OSHA records

Recordable or not: cases from landscaping

  • Water and a cool place to rest are first aid for heat stress; IV fluids are medical treatment, so the case is recordable. (29 CFR 1904.7(b)(5)(ii)(N))
  • Seasonal or temporary workers your crew leaders supervise day to day go on your log. (29 CFR 1904.31(b)(2))

For a case of your own, the recordable checker walks through the same rules.

Landscaping: recordkeeping questions

How many employees before a landscaping company has to keep an OSHA 300 log?

Eleven at any point during the last calendar year. Landscaping isn't partially exempt by industry, so the only exemption is having 10 or fewer employees at all times, counted company-wide (29 CFR 1904.1). Seasonal workers count while they are on your payroll, which is why the summer peak usually decides it.

Does a landscaping company have to file with OSHA by March 2?

Landscaping is part of NAICS 5617, services to buildings and dwellings, which is in appendix A to 29 CFR 1904.41: an establishment with 20 or more employees at any time last year submits its 300A by March 2. It isn't in appendix B, so 300 and 301 case data is not required, even above 100 employees.

What is the difference between the OSHA 300 and the 300A for a landscaper?

The 300 log is where each case goes during the season, within 7 calendar days (29 CFR 1904.29(b)(3)): a cut from a trimmer that needs stitches, heat illness treated with IV fluids. The 300A is the yearly summary of that log, certified by a company executive and posted from February 1 to April 30 (1904.32), in the off-season, when the summer crew may be gone. The 2024 landscaping average was 3.0 recordable cases per 100 full-time workers.
